Anyone who purchased in full or in part, for one or more prescription drugs at Kroger using insurance between December 9, 2018 and August 23, 2026
What’s This Class Action Settlement About?
The lawsuit claims Kroger improperly reported higher “usual and customary” prices for prescription drugs covered by insurance instead of considering the lower prices available through its Savings Club.
Who Qualifies for the Settlement?
Any U.S. resident who purchases one or more prescription drugs at Kroger using insurance between December 9, 2018 and August 23, 2026 and paid all or part of the cost.
How Much Money Can You Get?
Kroger has agreed to pay $17 million and the net settlemnet fund will be divided among eligible class members after fees, deductions and other costs.
Is Proof Required?
Proof is not nesscairly required for everyone. If you received a notice and claim ID numbe, you are considered a “Known Claimant”, although you will still need to submit a claim form and may be asking for supporting information.

- Claim Deadline: December 21, 2026
- Exclusion Deadline: October 22, 2026
- Final Approval Hearing: January 11, 2027 at 10:00 a.m. EST
